Terms of Service

These Terms of Service ("Terms") govern your use of the Capeum mobile application ("App") operated by Hyrum Harris ("we", "our", "us"). By creating an account or using the App, you agree to these Terms.

1. Description of Service

Capeum is a work photo organizer that allows teams to capture, organize, and share work photos. The App provides camera functionality, photo organization by customer, site, and equipment, and team collaboration features.

2. Account Registration

You must provide a valid email address and create a password to use the App.
You must verify your email address before accessing the App.
You are responsible for maintaining the security of your account credentials.
You must be at least 13 years old to create an account.

3. Acceptable Use

You agree to use the App only for lawful purposes related to work photo organization. You may not:

Use the App to store or distribute illegal, harmful, or objectionable content.
Attempt to gain unauthorized access to other users' accounts or data.
Interfere with or disrupt the App's infrastructure or services.
Use the App for purposes unrelated to its intended work photo functionality.

4. Your Content

You retain ownership of all photos and data you upload to the App.
By uploading content, you grant us a limited license to store, process, and display your content as necessary to provide the service to you and your team.
You are responsible for ensuring you have the right to upload any content you submit.
Photos and organizational data you create are accessible to other members of your company within the App.

5. Intellectual Property

The Capeum application, including its design, software, logos, and trademarks, are the intellectual property of Hyrum Harris and may not be copied, modified, or redistributed without permission. These Terms do not grant you any rights to our intellectual property except the limited right to use the App as intended.

6. Company and Team Structure

Users may create a new company or join an existing company using an invite code.
Company administrators can manage team members, including inviting and removing users.
If you delete your account, photos and data you created may remain accessible to your company.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Service Availability

We strive to keep the App available and reliable, but we do not guarantee uninterrupted access.
The App includes offline functionality. Data created offline will sync when connectivity is restored.
We may perform maintenance or updates that temporarily affect availability.

9. Account Deletion

You may delete your account at any time through the App's settings. Upon deletion, your personal account information will be removed. Photos and organizational data you contributed may remain available to your company.

10. Indemnification

You agree to indemnify and hold harmless Capeum and its operator from any claims, damages, or expenses arising from content you upload, your violation of these Terms, or your use of the App.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. We will make reasonable efforts to notify you before taking such action, except in cases of severe violations.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim, if any.

13. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, whether express or implied. While we take reasonable measures to protect your data, no system can guarantee absolute protection against data loss. You are responsible for maintaining your own backups of critical data.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the State of Utah.
