These Terms of Service ("Terms") govern your use of the Capeum mobile application ("App") operated by Hyrum Harris ("we", "our", "us"). By creating an account or using the App, you agree to these Terms.
Capeum is a work photo organizer that allows teams to capture, organize, and share work photos. The App provides camera functionality, photo organization by customer, site, and equipment, and team collaboration features.
You agree to use the App only for lawful purposes related to work photo organization. You may not:
The Capeum application, including its design, software, logos, and trademarks, are the intellectual property of Hyrum Harris and may not be copied, modified, or redistributed without permission. These Terms do not grant you any rights to our intellectual property except the limited right to use the App as intended.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
You may delete your account at any time through the App's settings. Upon deletion, your personal account information will be removed. Photos and organizational data you contributed may remain available to your company.
You agree to indemnify and hold harmless Capeum and its operator from any claims, damages, or expenses arising from content you upload, your violation of these Terms, or your use of the App.
We reserve the right to suspend or terminate accounts that violate these Terms. We will make reasonable efforts to notify you before taking such action, except in cases of severe violations.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim, if any.
The App is provided "as is" without warranties of any kind, whether express or implied. While we take reasonable measures to protect your data, no system can guarantee absolute protection against data loss. You are responsible for maintaining your own backups of critical data.
We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the State of Utah.
